Yes, it can have those sides.

If any side is >= the sum of the other 2 sides, or <= the difference of the other 2 sides, it's not possible to form a triangle.

I can only guess that tobias checked to see it 4, 9 and 8 made a right triangle. They don't, but they can make a triangle.
