It depends on your particular definition of a kite.
The broadest definition where rhombi and squares are considered special cases of the kite and concave polygons (sometimes called darts) are included in the definition of a kite, any point of the form (9,y) for all real y not equal to 11 would satisfy the requirement. If (9,11) were the 4th point, then you would not have a quadrilateral at all.
If rhombi and squares are excluded, then y = 5 must be excluded.
If concave polygons are excluded, then y > 5 must be excluded.
